Welcome to Moroccan Tan. This page sets out the legal terms, privacy practices, and customer policies that apply when you visit or purchase from any Moroccan Tan website, including www.moroccantan.com, www.moroccantan.com.au, www.moroccantan.co.uk, and any other regional extensions operated by Moroccan Tan Pty Ltd (ABN 52 159 135 850) ("we", "us", "our").

Moroccan Tan supplies products globally, including to customers in Australia, New Zealand, the United Kingdom, the European Union, and selected international destinations. These Terms and Policies are intended to apply globally, subject to any mandatory local consumer protection, privacy, or regulatory laws that apply in the customer’s country of residence. Where local laws provide additional rights that cannot be excluded, those rights will prevail to the extent of any inconsistency.

By using our websites or purchasing from us, you agree to these Terms and Policies.

1. Terms of Service

1.1 Acceptance of Terms

By accessing or using our website or purchasing products, you agree to be bound by these Terms. We may update them from time to time. Your continued use signifies acceptance of the current version.

1.2 Eligibility

You must be at least 18 years of age, or have parental or guardian consent, to make purchases.

1.3 Products and Information

We strive for accuracy in product descriptions, pricing, and imagery. Minor variations may occur, and product availability may change without notice. If we identify a material error (including pricing), we may cancel an order and refund amounts paid.

1.4 Pricing, Taxes, and Duties

Prices are displayed in the currency shown on the website you are using. Where required by law, taxes may be applied at checkout or included in the displayed price. For international shipments, import duties, customs fees, VAT, sales tax, or other government charges imposed by your country may apply and are the responsibility of the customer, unless we expressly state otherwise at checkout.

1.5 Orders and Payment

Orders are subject to availability and confirmation. Once payment is received, you will receive an order confirmation. We may refuse or cancel an order in cases of suspected fraud, pricing errors, or stock limitations. If we cancel an order after payment, we will refund amounts paid for the cancelled items.

1.6 Intellectual Property

All trademarks, trade names, logos, product names, imagery, designs, and content displayed on our websites are owned by or licensed to Moroccan Tan Pty Ltd and/or its related entities. You must not reproduce, distribute, or use our brand assets without prior written consent, except as permitted by law.

1.7 Limitation of Liability and Consumer Rights

To the extent permitted by law, we are not liable for indirect, incidental, or consequential losses arising from website use or product purchase.

Nothing in these Terms excludes or limits any rights or remedies that cannot lawfully be excluded under applicable consumer protection laws, including the Australian Consumer Law, the New Zealand Consumer Guarantees Act, the UK Consumer Rights Act 2015, EU mandatory consumer protections (as implemented locally), or equivalent laws in other jurisdictions.

1.8 Governing Law

These Terms are governed by the laws of Victoria, Australia. Courts of Victoria have non-exclusive jurisdiction. Nothing in this clause limits any mandatory consumer rights or protections available in your country of residence.

1.9 Definitions

  • Consumer means an individual or entity that acquires goods or services from Moroccan Tan that are ordinarily acquired for personal, domestic, or household use, or where the price paid does not exceed the statutory threshold under the Australian Consumer Law (or an equivalent threshold or definition under applicable local law).
  • Trade Account means a customer, salon, clinic, distributor, reseller, or business entity that acquires goods or equipment from Moroccan Tan wholly or predominantly for professional, commercial, resale, or business-use purposes, and not for personal, domestic, or household use.

1.10 Consumer Guarantees and Trade Accounts

Where goods or services are supplied to a Trade Account for professional or commercial purposes, consumer protections may not apply, or may be lawfully limited, to the extent permitted by law.

For Trade Accounts, Moroccan Tan’s liability is limited, at its election, to one or more of the following:

  • replacement of the goods or supply of equivalent goods;
  • repair of the goods;
  • payment of the cost of replacing the goods or acquiring equivalent goods; or
  • payment of the cost of having the goods repaired.

To the extent permitted by law, Moroccan Tan excludes liability for indirect, incidental, or consequential loss, including loss of profits, loss of business, downtime, or loss of opportunity, arising from the supply or use of goods supplied to Trade Accounts.

Nothing in this clause excludes or limits any rights or remedies that cannot lawfully be excluded under applicable law.

1.11 Equipment and Third Party Products

Some products sold by Moroccan Tan, including professional equipment and accessories, are manufactured and branded by third parties and supplied by us on a resale basis only. Where equipment is manufactured by a third party, Moroccan Tan does not manufacture, design, or control those products. Any manufacturer warranties are provided by the relevant manufacturer and are subject to that manufacturer’s terms and conditions.

Nothing in these Terms excludes or limits any non-excludable rights or guarantees available to consumers under applicable consumer protection legislation.

1.12 Electrical Equipment Disclaimer

Certain products supplied by Moroccan Tan include electrical or powered equipment intended for professional or commercial use. Electrical equipment must be installed, operated, maintained, and used strictly in accordance with the manufacturer’s instructions, applicable safety standards, and local electrical regulations. Moroccan Tan is not responsible for faults, damage, or safety issues arising from improper installation, misuse, modification, unauthorised repairs, incompatible power supply, voltage irregularities, or failure to comply with operating instructions.

Where electrical equipment is supplied to a Trade Account, and to the extent permitted by law, Moroccan Tan excludes liability for business interruption, loss of income, downtime, or consequential loss resulting from equipment failure or malfunction.

Nothing in this clause excludes or limits any non-excludable rights or guarantees under applicable consumer protection legislation.


2. Privacy Policy

2.1 Purpose and Applicable Laws

We are committed to protecting your privacy. We handle personal information in accordance with the Privacy Act 1988 (Cth) (Australia) and the Australian Privacy Principles, and we take reasonable steps to comply with applicable privacy and data protection laws in other jurisdictions where relevant (including the New Zealand Privacy Act 2020 and, where applicable, the EU GDPR and UK GDPR).

2.2 What We Collect

We may collect information such as:

  • Name, business or company name, and contact details
  • Billing and delivery addresses
  • Email, phone number, and communication preferences
  • Business legal-entity name and registration details (for example ABN, EIN, VAT ID, or equivalent)
  • Order and transaction details (payments are processed via secure third-party providers)
  • Website usage data including cookies, analytics, and IP address

2.3 How We Use Your Information

We may use your information to:

  • Process and deliver your orders
  • Communicate updates or respond to queries
  • Verify business account details
  • Improve our products, website, and customer experience
  • Send service communications (for example order updates and account notices)
  • Comply with legal and regulatory obligations

2.4 Disclosure to Third Parties and Overseas Processing

We may disclose your information to trusted service providers for the purposes described above, including payment processors, shipping and logistics providers, IT and cloud service providers, website and ecommerce platforms, analytics providers, and marketing communications platforms.

Some service providers may store or process data outside your country of residence (including in Australia and other countries). We take reasonable steps to ensure that overseas recipients handle personal information in a manner consistent with applicable privacy laws.

2.5 Cookies and Analytics

Our websites use cookies and similar technologies to ensure functionality, remember preferences, analyse traffic, and support marketing. Where required by law, we seek consent for non-essential cookies. You can manage cookies through your browser settings. Disabling cookies may affect website functionality.

2.6 Security and Storage

We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification, or disclosure, including using secure systems and restricting access. No method of transmission or storage is completely secure.

2.8 Marketing Communications

If you subscribe to our communications or opt in at checkout, you may receive marketing via email and SMS. You can opt out at any time by using the unsubscribe link in an email, replying STOP to an SMS, or contacting info@moroccantan.com.au. We do not sell your contact information.

2.9 Privacy Complaints

Please direct privacy concerns to info@moroccantan.com.au. We will investigate and respond within a reasonable time. If you are not satisfied, you may contact the Office of the Australian Information Commissioner (OAIC) or your local data protection authority.


3. Returns Policy

3.1 Overview

We take pride in the quality of Moroccan Tan products. If your item arrives faulty, damaged, or incorrect, we will offer a remedy in line with applicable consumer protection laws.

3.2 Eligibility for Returns

You may be entitled to a repair, replacement, or refund where a product is faulty, damaged, not as described, or otherwise fails to meet non-excludable consumer guarantees. For hygiene and safety reasons, we do not accept returns for change of mind for products that have been opened, used, or tampered with, except where required by law.

3.3 Return Procedure

  1. Contact info@moroccantan.com.au as soon as reasonably practicable after delivery and include your order number, a description of the issue, and photographs where applicable.
  2. We will assess your claim and provide return instructions where required, including the return address and the next steps.
  3. Refunds (where applicable) are processed to the original payment method once items are received and inspected, or once the claim is otherwise verified, within a reasonable time.

Where applicable consumer law provides more generous rights than stated here, those statutory rights will apply.

3.4 Trade and Distributor Accounts

Trade and distributor relationships may be governed by separate contractual terms and commercial schedules, at our absolute discretion, subject to applicable law. Any returns or replacements under such agreements must comply with the specific provisions outlined in those agreements.

3.5 Trade and Distributor Account Orders

a. Product Shelf Life and Stock Rotation

Moroccan Tan professional tanning solutions are formulated with naturally derived and organic ingredients, and as such, they are subject to natural variation and gradual ingredient breakdown over time.

The Exotic Collection generally has a shorter shelf life than the Originals, owing to its higher natural composition. While most unopened solutions that have been appropriately stored will maintain optimal performance for approximately two years from the production date, storage and shelf display conditions significantly affect longevity, and these factors are outside our control once the product has been dispatched to the customer.

To preserve product quality, we recommend:

  • Storing all products below 20°C and out of direct sunlight;
  • Using products within 2 years from production date; and
  • Once opened, using within 6 months and keeping the cap sealed tightly between uses.

In warmer climates or non-temperature-controlled environments, salons and stockists should rotate stock within 12 to 18 months to ensure active ingredient (DHA) effectiveness and avoid diminished tanning performance.

While products may appear visually unchanged, the DHA (active tanning ingredient) naturally degrades over time, which may result in reduced or inconsistent results.

b. Return Eligibility for Trade, Wholesale and Professional Orders

Due to the professional nature of these products and their dependence on storage and handling conditions outside our control, Moroccan Tan will only accept refund or exchange requests for trade, wholesale, or professional products that:

  • Were purchased directly from Moroccan Tan Pty Ltd; and
  • Are within 12 months from the date of purchase.

Returns will not be accepted where performance issues are reasonably attributable to storage, environmental exposure, extended shelf time, or stock rotation practices. This limitation does not apply to any rights or remedies that cannot lawfully be excluded under applicable consumer protection laws.

c. Tanning Essentials Equipment - Warranty Claims

Certain equipment and accessories sold by Moroccan Tan, including items branded as Tanning Essentials, are manufactured and warranted by third parties. Moroccan Tan does not manufacture, own, or control the Tanning Essentials brand or its products and supplies these items on a resale basis only.

Where a customer acquires Tanning Essentials equipment as a consumer, Moroccan Tan will comply with all non-excludable consumer guarantees applicable in the customer’s jurisdiction.

For Trade Accounts, warranty claims are limited to the manufacturer’s warranty terms. Moroccan Tan’s role is limited to providing reasonable assistance in facilitating communication with the manufacturer.

To the extent permitted by law, Moroccan Tan is not liable for business interruption, downtime, loss of income, or consequential losses arising from equipment failure in a professional or commercial setting.

d. Freight Costs for Equipment Warranty Claims (Trade Accounts)

For warranty claims relating to Tanning Essentials equipment made by a Trade Account, replacement parts or products may be subject to freight or delivery charges, unless otherwise required by applicable law.

Unless agreed in writing, the Trade Account customer is responsible for delivery costs associated with warranty replacements. Where replacement parts or products are shipped with a new order, delivery fees will be applied in accordance with the standard shipping terms applicable to that Trade Account.

This clause does not apply to any costs that cannot lawfully be charged under applicable consumer protection laws.

3.6 Consumer Rights

Nothing in this Returns Policy limits your rights under applicable consumer protection legislation in your jurisdiction.


4. Shipping Policy

4.1 Processing Times

Orders are generally processed within 1 to 2 business days (excluding weekends and public holidays). Once your order is dispatched, its status will be updated within your online account or order record on our website. Our system may also issue an automated email notification confirming that your order has been shipped.

4.2 Delivery and Collection Options

We deliver domestically throughout Australia and the United Kingdom, and to selected international destinations. Domestic orders are sent via our nominated courier.

Customers may request to collect goods in person or arrange their own domestic courier or international freight forwarder, provided that we are notified and agree in writing in advance of dispatch. Where collection or customer-arranged carriage occurs, responsibility for loss or damage may transfer once goods are collected from our facility or handed to the customer’s nominated carrier, subject to any non-excludable rights under applicable law.

4.3 Shipping Fees


Shipping costs are calculated at checkout based on order weight, value, and destination. We offer free standard shipping on qualifying orders for salon and retail customers only, as follows:


Australia: Free shipping on orders over AUD $75
United Kingdom: Free shipping on orders over GBP £60


Distributor, trade, education, and wholesale orders are not eligible for free shipping. Shipping fees for these orders will be calculated and displayed at checkout regardless of order value.


In some cases, shipping costs for distributor, trade, education, or wholesale orders may require manual calculation due to factors including but not limited to, order weight, carton dimensions, freight class, destination, or transport provider requirements. In such cases, we reserve the right to invoice shipping charges separately where accurate shipping costs cannot be reasonably calculated at checkout.


Orders that do not meet the above free-shipping thresholds, as well as orders shipped to all other destinations, will have shipping fees calculated and displayed at checkout.


Free shipping promotions may apply from time to time and may be subject to additional terms and exclusions.

4.4 Tracking

Tracking numbers are uploaded to your order record within our platform or website. This system may automatically send a shipping confirmation email with the tracking link.

4.5 Delays or Issues

We are not responsible for delays beyond our control (including courier disruptions or customs inspections), but we will provide reasonable assistance to help you resolve delivery issues.

4.6 Lost, Damaged Parcels and Shipping Protection

We take care to ensure your order is packed securely. If your parcel is lost, stolen, or arrives damaged, please notify us at info@moroccantan.com.au within 7 days of the delivery date (or expected delivery date if the parcel has not arrived) and include your order number, tracking details, and clear photographs (if applicable).

Shipping Protection Coverage

At checkout, customers may purchase Shipping Protection to safeguard their order in transit. This optional service provides priority handling of claims for:

  • Loss of parcels confirmed missing by the carrier;
  • Theft of parcels after verified delivery (where evidence supports the claim); and
  • Damage sustained during transit that renders items unusable.

Claims under Shipping Protection must be lodged within 14 days of delivery or expected delivery date. Proof of loss or damage (including carrier confirmation, photos, or documentation) may be required. Once approved, we will arrange either a replacement shipment of the affected products or a refund of the product value (excluding the Shipping Protection fee), subject to applicable law.

If Shipping Protection is not purchased, we may still assist by liaising with the carrier to investigate the matter. Replacements or refunds for lost or damaged parcels will be determined based on the carrier’s outcome and applicable consumer protection laws.

Shipping Protection does not cover delivery delays, customs holds, incorrect shipping addresses, or circumstances outside the carrier’s control.

4.7 International Orders and Business Registration Details

International customers are responsible for import duties, customs charges, and local taxes. For compliance and invoicing, we may request your business registration details issued by your local authority. Examples are listed below.

4.8 Incorrect Address or Non-Delivery

Please ensure your shipping details are accurate. If a parcel is returned due to an incorrect or incomplete address, we may re-ship at your expense or refund the order less shipping and handling costs, subject to applicable law.
